Trademark Litigation
The intellectual property litigation group at Weiss & Moy, P.C. has substantial experience in all phases of dispute resolution regarding claims of trademark infringement – from the preparation of cease and desist letters and responses thereto to litigation in federal district court and bankruptcy court. This includes the high-stakes process of seeking, or defending against, requests for temporary restraining orders and preliminary injunctions.
A company that is being sued for trademark infringement runs the risk of forfeiting a reputation that took many years to develop. In a 2004 Business Week survey, it was determined that a company’s trademark is often its most valuable asset, representing the goodwill and quality of the products or services provided. For example, the Coca-Cola ® trademark was valued at approximately $67 billion, Microsoft’s ® name was worth $61 billion, and the McDonald’s ® trademark was valued at $25 billion. There are many fast food chains that sell hamburgers, but it is the trademarked "McDonald’s" ® name and golden arches logo that generate so much revenue.
