We also wanted the firm to bill for its services in a way that allows clients to have cost certainty. Thus, while most lawyers bill for their services on a per-hour basis -- and while that kind of billing may be necessary in some legal areas -- the patent area lends itself nicely to fixed-fee billing. With flat-fee billing, we give you a binding quote for our work at the beginning, so you know exactly what you are getting into. Our years of experience with respect to all types of technologies allows us to accurately gauge the amount of work that will be necessary for a particular patent application, and to provide an accurate price quote based on that initial review. You can then budget for legal expenses in the same way that you might budget for research and development, marketing, or other expenses. In 29 years of private practice, we have found that clients find this type of billing for patent work to be extremely beneficial.
While some websites advertise low rates for legal services, it is important to realize that many of these companies either do not use attorneys or do not employ experienced attorneys. While some websites offer low fees, you are often receiving little or no trained legal advice, which can damage or destroy your intellectual property rights. Our flat-fee patent billing structure for patent-related services is generally as follows:
- Patent Search $1500
- U.S. Utility Patent Application Preparation: $6,000-$15,000 depending on complexity
- U.S. Design Patent Application Preparation: $1,500
- Patent Amendment: $500-$3,000 depending on complexity
- Patent Appeal: $1,000-$3,000 depending on complexity
- Patent Licensing Agreements: $1,000-$3,000 depending on complexity
- Patent Drawings: $150/sheet
- U.S. Utility Patent Application Filing Fees: $462 and above depending on the number and type of patent claims
- U.S. Design Patent Application Filing Fees: $230
- U.S. Provisional Patent Application Fee: $110
