While most law firms bill for their services on an hourly basis, Weiss & Moy, P.C. utilizes fixed fee billing with its clients for all aspects of IP protection, including prosecution, registration, and entity formation work.

Based on more than twenty-five years of experience with this billing method, we have found fixed-fee billing to be greatly preferred by our clients who are pursuing patent, trademark, copyright or corporate protection. A fixed-fee permits clients to make legal expenses a predictable part of a budgeting process and prevents surprises. In this way, a client can budget for legal expenses in the same way as the client budgets for research and development, marketing, and other expenses.

With respect to patent, trademark or copyright disputes and litigation, we do provide an estimate for the potential costs. However, given the unpredictability of litigation, we normally do not offer a fixed-fee for this type of representation. Nevertheless, Weiss & Moy, P.C. has on two occasions in recent years negotiated agreements with clients that establish a "not to exceed" cap for monthly fees. Our experience litigating these types of cases gives us confidence that we can estimate future fees with a reasonable degree of accuracy, which is a necessary precondition to entering into this type of fee arrangement.
